1. Acceptance of Terms
By accessing and using Marso, you agree to be bound by these terms and conditions (Terms). If you do not accept these terms, do not use Marso.
2. License Grant
Subject to your compliance with these Terms, M-XR Ltd. grants you a non-exclusive, non-transferable, revocable license to use Marso for your personal and/or business use on the terms and conditions set forth herein.
3. Use of Open Source Software
Marso includes components that are licensed under a variety of Open Source licenses. Further Information can be found in the Open Source Components and Licenses section below.
4. Intellectual Property Rights
All intellectual property rights in Marso, except for the components covered by the CDDL and other open source licenses, are owned by M-XR Ltd. and/or its licensors. The use of Marso does not grant you any rights to the intellectual property of M-XR Ltd. except the licenses expressly granted herein.
5. Restrictions
You may not:
Reverse engineer, decompile, or disassemble Marso, except to the extent that such activity is expressly permitted by applicable law notwithstanding this limitation.
Remove any copyright notices or other proprietary markings on Marso.
Use Marso to engage in any unlawful activity or in any manner that violates these Terms.
6. Disclaimer of Warranty
Marso is provided "as is" and without warranties of any kind, either express or implied. M-XR Ltd. disclaims all warranties, including, but not limited to, implied warranties of merchantability and fitness for a particular purpose.
7. Limitation of Liability
In no event shall M-XR Ltd. be liable for any direct, indirect, incidental, special, consequential, or exemplary damages, including but not limited to, damages for loss of profits, goodwill, use, data or other intangible losses (even if M-XR Ltd. has been advised of the possibility of such damages), resulting from the use of or the inability to use Marso.
8. Indemnification
You agree to indemnify, defend, and hold harmless M-XR Ltd., its officers, directors, employees, agents, licensors, suppliers, and any third-party information providers to the Service from and against all losses, expenses, damages, and costs, including reasonable attorneys' fees, resulting from any violation of these Terms (including negligent or wrongful conduct) by you or any other person accessing the Service.
9. Modification of Terms
M-XR Ltd. reserves the right to modify these Terms at any time. Your continued use of Marso after such modifications will constitute acknowledgment and agreement of the modified terms.
10. Severability
If any provision of these Terms is found to be invalid by any court having competent jurisdiction, the invalidity of such provision shall not affect the validity of the remaining provisions of these Terms, which shall remain in full force and effect.
